By using Certified Content Mail LLC ('CCM') services, you agree to the following terms and conditions. Please read them carefully before submitting any document or payment.
Throughout these Terms and Conditions, the following acronyms and definitions apply:
Information Visible to Recipient and on Evidence: You accept that the content of the mailed envelope will include:
You Must Preserve Emailed Evidence: We will provide a Certificate of Mailed Content™ via email one time only to the email address used for the transaction. We do not make available document contents or the Evidence beyond the conclusion of the transaction. You agree to accept the responsibility to preserve your received Evidence according to emailed instructions for as long as Evidence is desired.
Print Quality
Photo Quality: Photo resolution and quality is generally adequate for capturing common fonts at common sizes. However, we make no guarantees regarding legibility of the Evidence photograph. The photographic Evidence may not be able to capture small details, and small text may not be legible in the photograph.
Evidence of Delivery is Your Responsibility: Our service is to provide you with Evidence of mailed content and tracking information. While we may also provide evidence of delivery, this is a courtesy and NOT a guarantee. It is your responsibility to obtain any desired evidence of delivery, including an electronic return receipt if selected, directly from the United States Postal Service using the provided tracking information.
Delivery Not Guaranteed: Once the envelope is transferred to the United States Postal Service, your business transaction with us is complete and we will charge your account. We do NOT guarantee actual delivery of the mailed envelope by the courier to the Recipient or Recipient address. We also do NOT guarantee delivery to you of the Certified Mail Return Receipt. By using our service, you accept the risk of delivery failure of both envelope and Return Receipt, for any reason without reimbursement. In the event that delivery of either fails for any reason:
Order Confirmation and Cancelation: CCM processes and mails most orders within one (1) business day. However, confirmation of USPS acceptance may take additional time due to courier processing schedules, weekends, or federal holidays. If CCM cannot confirm a USPS scan verifying that your mail has entered USPS possession within seven (7) calendar days of order placement, no charges will be applied to your account, and the order may be canceled. It is possible for the item to have been physically transferred to USPS even if a scan is unavailable; in such cases, CCM will still treat the order as canceled and bears no responsibility for any resulting delay, delivery, or non-delivery by USPS.
Utility of Evidence: CCM provides Evidence "as is", with NO guarantees whatsoever, expressed or implied, that such Evidence will be useful, acceptable, or satisfactory to any party, or that such Evidence will be permissible in a court or arbitration environment. CCM will NOT and indeed has no capability to furnish additional evidence or provide any additional attestation to you, or any other party. CCM will NOT issue any refund in the event that provided Evidence is unsatisfactory or unuseful to any party.
Sender Representation and Authorization: By using the services of CCM, you agree to provide your true and accurate information in the Sender fields when initiating a mailing transaction. If you are acting on behalf of another person or entity, you must possess explicit written authorization from such person or entity to agree to these terms on their behalf and to complete the mailing transaction on their behalf. It is your responsibility to ensure that all information entered into the Sender fields accurately reflects the identity of the person or entity legally responsible for the transaction and that you have the requisite authority to act in such capacity.
Suitability of Service: Some types of legal notices and documents and/or the information contained therein are governed by laws, rules, and regulations requiring specific delivery or service methods. CCM does NOT attest nor imply that Certified Mail® is an appropriate mode of delivery for any document.
Timeline for Reporting Major Issues: If your account is charged but you do not receive your Evidence, or if your Evidence is corrupted, unreadable, or your order otherwise fails to meet expectations, you must contact CCM within fifteen (15) business days of placing your order. CCM will review any timely and valid report and, at its sole discretion, either resolve the problem or issue a full refund. After this period, CCM's ability to investigate or resolve any issue is no longer guaranteed, and you agree to hold harmless CCM for any unreported or unresolved errors, even if the mail was sent or delivered to the recipient.
Technology and Support: Although we attempt to streamline the process of demonstrating the validity of Evidence, the use of our website and tools to this end is a courtesy and not a guarantee. In some circumstances such as technical difficulties on our website or discontinuation of business, demonstrating Evidence may be difficult or infeasible. We do NOT provide technical support for any demonstrations.
Limitations of Cryptographic Technologies: Our services rely on standard cryptographic technologies that, while currently widely adopted, are not infallible. These technologies can potentially become compromised due to advancements in computing (such as quantum computing), discoveries in mathematics, or flaws in software or hardware. The cryptographic verification provided at the time your content is mailed is static and cannot adapt to future technological changes. By using our services, you acknowledge and accept the risk that the cryptographic signature may eventually be deemed invalid. You agree to accept the Evidence "as is," understanding that CCM is not liable for, nor will it provide reimbursement for, any failure resulting from compromised cryptographic technologies.
Legality of Uploaded Content: By using our services, you affirm and warrant that you possess the legal right and have secured all requisite consents necessary to upload, transmit, and mail the information contained in the document(s) you provide. You affirm that the document(s) do not include any unlawful, sensitive, or private information - including intellectual property or copyright infringements - that would prohibit its lawful upload to our servers, duplication and handling by our staff, or delivery to the designated recipient. You acknowledge and accept sole responsibility for the content of the document(s) and agree to indemnify and hold harmless CertifiedContentMail.com from any claims, liabilities, damages, or expenses that arise from the content of the document(s) or any breach of these terms.
Authorization to Act as Mailing Agent: By using our services, you authorize CCM to act as your mailing agent for the limited purpose of preparing, handling, and submitting mail to the United States Postal Service (USPS) on your behalf. You acknowledge that this authorization is granted exclusively for the execution of mailing services as described on our website and does not extend to receiving mail or any other activities beyond those necessary to fulfill these services.
Endshipper Responsibility: While CCM acts as your mailing agent in fulfilling mailing requests according to your submitted order, you acknowledge that CCM is the legally recognized endshipper in USPS records for all mailings submitted through our system. Accordingly, CCM is financially responsible for postage and may be identified as the sender on record. You, however, remain solely responsible for the content and legality of documents you upload to our system, and agree to indemnify and hold harmless CCM for any claims arising from your use of the service.
Public Record Policy: CCM maintains a permanent public record of all mailed transactions for the life of the business. These records are anonymous and reveal no meaningful details without the associated Certificate of Mailed Content™. CCM will not redact or modify any public record for any reason except by lawful court order. It is your responsibility to maintain control of your Certificate of Mailed Content. Publication or unauthorized sharing of the Certificate by you or by any other party is not grounds for redaction or removal of the corresponding public record.
Acceptable Use: You agree not to abuse, misuse, or interfere with CCM's website, systems, or services. This includes, but is not limited to, attempting to access unauthorized data, automating use of the service, deploying bots or scripts, probing or testing for vulnerabilities, or using the service in any way contrary to its apparent design or intended purpose.
Geographic Limitation: You must be physically located within the United States when placing an order through CCM. Our services are not available to users outside the United States.
Service Availability: CCM strives for continuous availability of its website and services but does not guarantee uninterrupted operation. Planned maintenance or unexpected outages may occur without notice. When possible, CCM will make reasonable efforts to communicate planned downtime in advance.
Cookies and Browser Data: CCM uses session and necessary cookies to maintain essential website functionality. These cookies are not used for tracking or shared with any other party except for essential payment processing functions. By using our website, you consent to the use of these necessary cookies.
Payment and Fulfillment: All payments are processed securely through a third-party payment provider. In the event of a payment or fulfillment error, CCM will not charge your account if the mailing cannot be completed. However, successful order fulfillment is not guaranteed, and CCM is not liable for any indirect or consequential damages resulting from processing errors or interruptions.
Force Majeure: CCM shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, labor disputes, power outages, postal service disruptions, or failures of telecommunications or internet infrastructure.
Dispute Resolution and Jurisdiction: Any dispute arising under these Terms and Conditions shall be governed by the laws of the Commonwealth of Pennsylvania. You agree that any legal action shall be filed and adjudicated exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.
Amendments to Terms: CCM may amend these Terms and Conditions at any time without prior notice. Each order will be recorded with the version of the Terms and Conditions in effect at the time of order placement. Customers are not separately notified of changes but agree to the current version of the Terms during each new order.
